Rapid Launch Website Agreement

48-Hour Rapid Launch Website

This Website Design Agreement (“Agreement”) is entered into between Kickass Websites (“Company”) and Client (“Client”) as of the date of purchase.

1. Scope of Services

Company will design and develop a lead-generation website under the Rapid Launch Website.

Services include:

  • Conversion-focused website design and build
  • Mobile-responsive layout
  • Implementation of Client-provided branding, messaging, and images
  • Basic contact or lead capture functionality
  • Deployment to a staging environment

This program is intended for rapid functional launch and does not include extensive custom design exploration, complex integrations, advanced SEO, or custom software development unless otherwise agreed.

2. Production Timeline

Production will begin once Client has:

  • Completed onboarding requirements
  • Submitted required content and assets
  • Provided necessary access credentials
  • Completed full payment

Initial delivery will occur within approximately 48 hours of receipt of all required materials.

Delays caused by missing information or lack of Client response will extend timelines accordingly.

3. Revision Policy

Client is entitled to one (1) revision round during the 48-hour production window.

Revision requests must:

  • Be submitted in one consolidated communication
  • Be limited to reasonable adjustments such as text edits, image replacements, minor layout changes, or styling refinements

Additional revisions may result in increased fees and extended timelines.

Requests involving structural redesign, new pages, or significant directional changes may be treated as a new scope of work.

4. Client Responsibilities

Client agrees to:

  • Provide accurate business information and content
  • Confirm they have legal rights to all submitted materials
  • Respond promptly to communications and approvals

Failure to provide timely responses may delay delivery or launch.

5. Payment Terms

Full payment is required prior to commencement of production.

Due to immediate scheduling and labor allocation, payments are non-refundable once production has begun, except as provided under the Satisfaction Guarantee in Section 11.

6. Ownership, Attribution & Portfolio Use

Upon full payment, Client receives the right to use the completed website for business purposes.

Client agrees that Company may include a discreet footer attribution such as “Built by Kickass Websites”, which may contain a hyperlink to Company’s website.

Removal or modification of this attribution may require written approval and may be subject to an additional fee.

Company retains the right to display the project in its portfolio, case studies, marketing materials, or promotional content.

7. Hosting Requirement

All websites require active hosting to be accessible online.

Websites built under the Rapid Launch Website program are delivered as a hosted solution, and hosting through Company is required for launch. Third-party hosting is not supported for this program.

Client acknowledges that the website cannot be made live until hosting services are activated.

Hosting plans start at $17 per month, depending on selected features and support level.

Failure to activate hosting may delay or prevent launch.

8. Project Communication & Completion

If Client does not provide required feedback, approvals, or revision requests within 7 calendar days, Company may consider the design approved and complete.

Design approval does not constitute launch. The website will not be made publicly accessible until hosting services have been activated by Client.

Any updates requested after approval may be subject to additional fees and scheduling availability.

9. Limitation of Services

The Rapid Launch Website program does not include:

  • Unlimited revisions
  • Advanced integrations or custom functionality
  • Ongoing SEO or marketing services
  • Custom software development
  • Ongoing support unless enrolled in a hosting or maintenance plan

Additional services may be quoted separately.

10. Acceptance

By purchasing the Rapid Launch Website program, completing online checkout, paying an invoice, or submitting onboarding materials, Client acknowledges they have read, understood, and agreed to this Agreement.

Electronic acceptance constitutes a binding service contract. No physical signature is required.

11. Guarantees

Company stands behind this program with three guarantees.

Speed Guarantee

The website will be delivered within 48 hours of receipt of all required materials. If Company fails to meet this timeline for reasons within Company's control, Client will not be charged.

Satisfaction Guarantee

Company will revise the website until Client is satisfied, within the scope defined in Section 3. If Client remains unsatisfied after the revision process and the website has not yet been published or made live, Client may request a full refund.

Once the website has been published and made live, the initial build is considered accepted. At that point, the project is non-refundable. Further changes may be requested but are subject to additional fees and scheduling.

Refund requests based on a perceived lack of sales, leads, traffic, or business results are not valid grounds for a refund under this guarantee or any other provision of this Agreement.

Value Guarantee

If Client finds a comparable service — same scope, speed, and written guarantees — offered for less, Company will beat that price.

What Company Does Not Guarantee

Company does not and will not guarantee any sales, leads, phone calls, revenue, search rankings, traffic, or business growth of any kind. A website is one piece of the puzzle, not the whole picture. Results depend on Client's own effort, offer, pricing, follow-up, market, and competition. That part belongs to Client.

12. Client Content & Asset Quality

Client is responsible for the quality and accuracy of all provided materials.

Company is not responsible for outcomes impacted by low-resolution images, ineffective branding, incomplete messaging, or inaccurate information.

Company may use reasonable placeholders or formatting adjustments to maintain production timelines.

Extensive content creation, branding redesign, or asset sourcing may incur additional fees.

13. Scope Expansion

Requests outside the defined project scope, including additional pages, structural redesign, integrations, or new functionality, may require revised pricing and timelines or transition to a custom engagement.

14. Design Approval & Launch Requirements

If Client does not respond within 7 calendar days after preview delivery, the website design may be deemed approved and finalized.

Approval of design does not result in automatic launch. The website will not be made publicly accessible until Client has activated an active hosting plan. Launch is Client's responsibility to initiate.

Subsequent updates after design approval may be billed separately.

15. Hosting Cancellation & Migration

Hosting is a core component of the Rapid Launch Website service.

If hosting is cancelled after launch, Company may remove the website from public availability and archive or delete project files.

Migration assistance or export requests may incur additional fees.

Company is not responsible for performance outside its hosting environment.

Hosting fees are recurring and non-refundable once billed.

16. Project Hold

Client may place their project on hold at any time by contacting Company via phone, email, or text. Once a hold is confirmed by Company, all project timelines are paused indefinitely until Client is ready to resume.

To resume, Client must contact Company and confirm readiness to proceed. Timelines and scheduling will be re-established at that time and are subject to availability.

17. Abandoned Project Reactivation

If Client becomes unresponsive for more than 30 calendar days without requesting a hold, Company may classify the project as abandoned.

Reactivation may require a reactivation fee, rescheduling, and updated timelines or pricing.

18. Payment Disputes & Chargebacks

Client agrees to contact Company to resolve concerns prior to initiating any payment dispute or chargeback.

Chargebacks after production has begun may be considered breach of this Agreement.

Company reserves the right to suspend services, terminate hosting, recover reasonable costs, and present this Agreement as evidence in dispute proceedings.

Business performance dissatisfaction is not valid grounds for dispute.
